Introduction to Legal Methodology

This foundational “Introduction to Legal Methodology” course provides students with a foundational understanding of the systematic approaches and intellectual tools essential for effective legal study and practice within the Cambodian context. Recognizing Cambodia’s unique hybrid legal system—amalgamating customary law, French civil law influences, and elements of common law from recent reforms—the course delves into how legal rules are created, interpreted, and applied. Students will learn to identify and analyze the diverse sources of law in Cambodia, including the Constitution, national legislation (Chbab), royal decrees (Preah Reach Kret), sub-decrees (Anu-Kret), by laws (Deika), relevant judicial decisions, and the increasing role of international treaties. The curriculum emphasizes the development of critical thinking skills crucial for dissecting legal problems, constructing sound arguments, and understanding the practical implications of legal theory. Through a combination of interactive discussions, case studies rooted in Cambodian legal scenarios, and practical exercises, participants will not only sharpen their analytical prowess but also cultivate an appreciation for the historical evolution and contemporary challenges of the Cambodian legal landscape, thereby fostering intellectual growth and problem-solving capabilities directly applicable to their iLAW program studies, moot court participation, and future professional endeavors.
